Ohio State faces failure to monitor charge

"In a signal that tougher penalties likely loom, the NCAA has notified Ohio State University that it is facing a charge of failing to monitor its violation-plagued football program. Failure to monitor is the second-worst finding the NCAA can impose on an athletic program. Ohio State announced the NCAA findings this afternoon and that it would cut five scholarships over a three-year period beginning next year. The NCAA allows football programs to have 85 scholarship players. A spokesman for Ohio State athletics said the self-imposed punishment would not mean the Buckeyes would pare back to 80 scholarships over the next three years. He said that the team might not use, say, two of the 85 in 2012, one in 2013 and two in 2014, for a total of five over the period. The NCAA previously had notified OSU that it was not being accused of failure to monitor or the worst charge — loss of institutional control. The NCAA’s move to invoke the charge now means that the NCAA considers the violations committed by Ohio State to stem from a central problem, rather than individual misdeed."

Both football coach Joe Paterno and president Graham Spanier are out at Penn State in the wake of a disturbing child sex abuse scandal involving a former assistant coach. Paterno said in a statement Wednesday he would retire after the season, but the university's board of trustees met Wednesday night and decided Paterno would not be allowed to continue as coach effective immediately. Assistant coach Tom Bradley has been named interim coach. Spanier chose to resign Wednesday and will be replaced temporarily by provost Rodney Erickson.

Education Department To Investigate Penn State Handling Of Child Abuse Case

It's nothing more than a headline right now, but the Department of Education is getting involved in this awful Penn State scandal. I'm one of the few non-lawyers on this site, so if anyone with a legal background wants to chime in, please do so. What does this mean? I didn't know the Education Department even had investigative powers, at least in the legal sense. Why the Education Department? Is it to look at avenues to eliminate federal funding or some other way to punish Penn State in ways that are apart and aside from the legal system? It seems that Penn State the academic institution is going to pay a steep, steep price for the heinous actions (and inaction) of a few.

Paterno to Retire at the End of the Season

The Associated Press is reporting that Penn State football coach Joe Paterno has decided to retire at end of the season. The AP source says Paterno will announce his retirement later Wednesday. [BH: EDIT w/ Paterno's Statement: "I am absolutely devastated by the developments in this case. I grieve for the children and their families, and I pray for their comfort and relief," Paterno said in a statement released just after initial reports of his pending retirement. "I have come to work every day for the last 61 years with one clear goal in mind: To serve the best interests of this university and the young men who have been entrusted to my care. I have the same goal today. "That's why I have decided to announce my retirement effective at the end of this season. At this moment the Board of Trustees should not spend a single minute discussing my status. They have far more important matters to address. I want to make this as easy for them as I possibly can. "This is a tragedy. It is one of the great sorrows of my life. With the benefit of hindsight, I wish I had done more. My goals now are to keep my commitments to my players and staff and finish the season with dignity and determination. And then I will spend the rest of my life doing everything I can to help this university."]

Things (that may be in conflict) to remember: 1. Who the real victims are. Joe Paterno is not one of them. 2. This scandal does not wipe away all the good things Joe Paterno has done over the course of his career, which are considerable. But his inaction in light of serious danger to children certainly diminishes his legacy. 3. Joe Paterno's legacy is not what we should be concerned with right now. I used to say I wanted Pat Fitzgerald to become Northwestern's version of JoePa. Now? I think he's better off just being Pat Fitzgerald.
